1. Introduction
This Master Service Agreement ("Agreement") is entered into by Valley Smart Homes LLC ("Provider") and the undersigned customer ("Customer") for the purpose of providing internet services in Chelan and Douglas counties. By using this service, the Customer agrees to the terms and conditions outlined herein.
2. Services Provided

Service Description: Residential internet service with the following available plans:

100 Mbps Monthly Plan
-
100 Mbps Annual Plan
-
1 Gbps Monthly Plan
-
1 Gbps Annual Plan
-

Installation: Installation at the Customer’s Chelan or Douglas County property as agreed upon during service activation.

Optional Add-Ons: Managed Wi-Fi, leasing/purchasing routers, additional security features, or other services as discussed and agreed upon.

Best Effort Service: The Provider will make commercially reasonable efforts to deliver the subscribed service; however, speeds and uptime are not guaranteed.
3. Billing and Payment Terms

Payments are due on the 1st of each month for monthly plans and upon activation for annual plans.

Installation and provisioning fees may apply.

Non-Payment: Failure to pay within 30 days may result in service suspension or termination. A fine may apply for overdue payments. If service is terminated due to non-payment, a reinstatement fee and the balance due must be paid before reactivation.

Proration Policy: If the Customer cancels before the end of an annual term, a prorated refund may apply for unused months.
4. Equipment Terms

Ownership: Any equipment provided by Valley Smart Homes LLC remains the property of the Provider unless explicitly sold to the Customer.

Maintenance: Customers must safeguard Provider-owned equipment. Damaged or lost equipment may result in additional fees.

Return Policy: Non-purchased equipment must be returned within 14 days of service termination to avoid replacement charges.
5. Acceptable Use Policy

The Service must be used in compliance with all applicable laws and regulations.

Prohibited activities include but are not limited to illegal activities, spamming, and unauthorized service sharing.

The Service is for residential use only.
6. Service Availability

Service Interruptions: While Valley Smart Homes LLC strives for uninterrupted service, occasional outages may occur.

Force Majeure: Valley Smart Homes LLC is not responsible for service failures due to events beyond its control, such as natural disasters, power outages, government actions, strikes, etc.
7. Installation and Property Access

The Customer consents to Valley Smart Homes LLC technicians accessing their property for installation and maintenance purposes.

Any modifications to the property (e.g., drilling, wiring) will be discussed and approved before installation.
8. Privacy and Data

Valley Smart Homes LLC collects and uses Customer information in accordance with its Privacy Policy, available at ValleySmartHomes.com.

Customer data will not be shared with third parties without consent, except as required by law.
9. Termination of Service

By Customer: Customers may terminate service by calling 509-557-0508.

By Provider: Valley Smart Homes LLC reserves the right to terminate service for non-payment or contract violations.

Non-Proration Policy for Monthly Plans: Monthly service fees will not be prorated upon cancellation.
10. Liability Limitations

Valley Smart Homes LLC is not liable for:

Interruptions caused by factors outside its control (e.g., natural disasters, power outages).

Damages arising from the Customer’s misuse of the Service.

Total liability is limited to the amount paid by the Customer for the previous month’s service.
11. Amendments and Governing Law

Valley Smart Homes LLC may update this Agreement with 30 days' notice.

This Agreement is governed by the laws of the State of Washington.
By using the services provided by Valley Smart Homes LLC, the Customer acknowledges and agrees to the terms and conditions outlined in this Agreement.
